PROGRAM:
The Unitary Patent and Unified Patent Court (UPC) is the biggest change to the patent landscape in Europe for 50 years. It will come into effect on June 1st, 2023 and will impact all aspects of patent practice: licensing, prosecution, and litigation. Come and find out from our expert panel what you need to know and what actions to take in order to prepare for this seismic shift. The program will be in the form of a panel discussion and will cover:

  • Scene-setting: what is the UP and UPC and how will it work?
  • Licensing: what actions should I take now in relation to existing licenses? What decisions do I need to make in future licenses and what are the implications on drafting and negotiation?
  • Strategy: how does this change impact on your patenting strategy in Europe? How does the opt-out system work?
  • Litigation: what do we know about the new Court? How does it impact on the European patent litigation landscape?

Take-aways:
When you leave the program, you will know what the UP and UPC are, how they are relevant to your business, and how to assess what steps you need to take now and in the future in relation to this new system.

ABOUT THE PANEL:
Brad Waugh, Associate General Counsel, Intel Litigation Group 
At Intel, Brad serves as a litigation manager for patent disputes in the U.S. and abroad. Before joining Intel, he practiced at the Cooley and Day Casebeer law firms. Brad holds degrees in electrical engineering from Georgia Tech and Rice, and a law degree from Stanford.

Morag Macdonald, Partner, Bird & Bird   
Morag has a real depth of experience with cross-border IP strategies - for litigation and transactions - addressing the commercial goals of her clients.  She is experienced in all forms of patent litigation and strategic advice, especially in an international cross-border context. She has led the team in over 25 trials before the UK Patents High Court and the UK Patents County Court. She has also been the lead coordinator on well over 20 matters with patent litigation in two or more European countries. As well as patent litigation, Morag has been the advocate in a number of patent related arbitrations, provided freedom to operate advice and due diligence reports to companies in the life sciences, financial services, tech & comms and energy sectors as well as advising several companies on their patent and IP strategies in over 40 jurisdictions.  She has a Masters degree from Cambridge University in Physics, Mathematics and Law.  She joined Bird & Bird's Intellectual Property Group in 1985 having originally trained as a barrister and became a partner in 1989.

Chris de Mauny, Partner, Bird & Bird
Chris litigates and advises on all forms of intellectual property litigation, principally patents. He has represented clients on a wide range of technologies including pharma, med-tech, hi-tech and communications, sustainable technologies and defense.  His clients range from small businesses to international corporations from many countries.  He has been a partner at Bird & Bird since 2021, previously an associate in the IP team for ten years.  Prior to that he was called to the English Bar and practiced in specialist intellectual property chambers.  Chris was identified as a "rising star" for patent litigation by Managing Intellectual Property in 2018 and again in 2019, was referred to as a "key lawyer" within Bird & Bird's London patent litigation team by Legal 500 and recognized as a 'Rising Star' for patents by Expert Guides, a peer-nominated international guide to lawyers. In 2021 he was one of four patent lawyers in Europe recognized for the ‘Rising Stars Awards 2020 – Europe.

Soody Tronson, Founding Managing Counsel, STLGIP 
Soody is a counsel, serial entrepreneur, inventor, and trusted advisor with over 25 years of interdisciplinary operational experience in innovation, technology, management, law, and advocacy in start-ups, Fortune 100 companies, and non-profits. Soody counsels domestic and international clients in intellectual property and technology transactions in various sectors, including hardware, software, medical devices, and alternative energy. Soody lectures on IP, licensing, technology transfer, and entrepreneurship domestically and internationally. She serves in a board, advisory, and leadership capacities with multiple organizations. She is the co-author of the book “Women Securing the Future with TIPPSS for IoT: Trust, Identity, Privacy, Protection, Safety, Security for the Internet of Things” and an inventor of several patents and applications. Soody is the CEO of Presque, a wearable health-tech platform in the maternity space. One of her most fun ventures has been as co-founder of HighNote Coffee.
