PROGRAM:
This is a special program hosted by the LES Silicon Valley and San Francisco Chapters. A version of this presentation was given to a packed room at the recently-concluded LES Annual Meeting in San Francisco. Based on its popularity, we are making it available to a wider audience as a special offering.

What do Prince, Andy Warhol, Hermes, Tarantino, Nike, Satan Shoes, Kim Kardashian, blood droplets, AI-generated art and NFTs have in common? They’re all part of the ongoing battles over using content that are playing out all around us. How do you create, protect, enforce and value art, music, designs and brands, whether human- or computer-created?

Our expert panel will discuss the latest developments and trends, including IP tools such as copyrights & trademarks, pending legislation, cutting-edge court developments, and the impact of technological tools such as NFTs and AI.

ABOUT THE PANEL:
Justin Lewis, Managing Director, Ocean Tomo
Justin joined J.S. Held in March of 2022 as part of J.S. Held's acquisition of Ocean Tomo. Mr. Lewis is an experienced expert who has testified in both federal and state court. He is a Managing Director in the Intellectual Property Disputes Financial Expert Testimony practice and leads the Risk Management and License Compliance practices of the San Francisco office of Ocean Tomo, a part of J.S. Held. Mr. Lewis’ over 20 years of consulting experience includes the analysis and quantification of economic damages arising from patent, trademark, trade secrets, copyright infringement & breach of contract in over a hundred matters. He has a solid understanding of the financial issues and theories related to intellectual property and breach of contract litigation from discovery to trial.

Shelly Gayner, General Counsel, Big Fish Games
Shelly is the General Counsel for Big Fish Games. Shelly is an accomplished attorney and business executive with over 30 years of experience. As Big Fish’s General Counsel, Shelly is responsible for leading the Big Fish corporate legal function and upholding the company’s highest standards of integrity and compliance. Prior to joining Big Fish, Shelly was Vice President of Business Development and Legal at GSN Games. She is a seasoned and versatile in-house counsel with deep experience in the video gaming sector. She began her career with console video games, holding key roles at Sega and the PlayStation division of Sony, and transitioned to the mobile gaming sector in 2016 when she joined GSN Games. Shelly has been an active volunteer for the Special Olympics in Northern California and is a tutor for Reading Partners Silicon Valley. In her spare time, Shelly can be found skiing, traveling, and rooting for the San Francisco 49ers. Shelly is a graduate of Pepperdine School of Law and UC Santa Barbara and is an active member of the State Bar of California and American Bar Association

Alice Kelly, Partner, Ice Miller LLP
Alice is an experienced IP professional based in Chicago. Ms. Kelly handles all aspects of trademark and copyright law, from clearance and registration to enforcement of those rights. She has tried cases in federal, state, and arbitral forums and routinely handles matters before the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office. Prior to joining Ice Miller, she practiced with global law firm DLA Piper and ran her own firm for seven years. Despite a busy litigation practice, Ms. Kelly has always devoted significant time to her community, including extensive pro bono representation of clients. Alice is the Chair of the International Trademark Association Pro Bono Committee for 2022-2023 with prior INTA Leadership roles. Alice has been in the World Trademark Review 1000 2020, 2021, and 2022. And, Alice was named a 2022 Crain's Chicago Notable Women in Law. Ms. Kelly is licensed in Illinois, California and Missouri and has lived in Chicago, San Francisco and St. Louis.
