The panel discussion will address benefits, risks, and practicalities of open source licensing across a number of domains, including developer participation in open source projects, inbound licensing and use of open source software in commercial and noncommercial settings, and outbound licensing and distribution of software as open source. The panel will discuss best practices for evaluating and approving participation in open source projects and use of third party open source code in software development. It will also examine open source license compliance and enforcement issues, including remedies in contract, copyright, and patent law.
Panelists:
Gabriel Ramsey, Partner, Crowell & Moring. Gabe is a member of the firm’s Litigation, Intellectual Property, and Privacy & Cybersecurity groups. He focuses his practice on complex litigation involving intellectual property and cybersecurity. He has substantial experience in high technology and entertainment-related matters involving trade secret, patent, copyright, and trademark law. He has significant experience in carrying out internet enforcement actions and investigations involving cybercrime, trade secret misappropriation, fraud and deceptive activity, data breaches, and brand violations. He has also handled many licensing matters, open source licensing disputes, and general commercial disputes.
Jim Wright, Chief Architect, Open Source Policy, Strategy, Compliance & Alliances, Oracle. Jim was a software engineer and development manager in the Silicon Valley throughout the 1990s, working as a consultant with a wide variety of well-known hardware & software companies including Adobe, Logitech, 3Com, and Lotus Development, and eventually rising to the level of Director of Developer Relations and General Manager of Java Product Development at InstallShield before heading back to law school at Harvard Law. As Oracle’s Chief Architect for Open Source Policy, Strategy, Compliance & Alliances, he reviews and approves all third party software and hardware in Oracle products on behalf of the Corporate Architecture team.
Imelda Oropeza, Licensing Associate, CLP, Office of Technology Licensing , Stanford University. Imelda currently manages a caseload of over 300 software-related inventions with subject areas spanning Stanford’s 7 Schools: Business, Earth Sciences, Education, Engineering, Humanities & Sciences, Law and Medicine. In addition to evaluating, marketing, and managing IP rights including patents, copyrights and trademarks for these inventions, Imelda is responsible for negotiating licensing agreements with companies that range from start-ups to Fortune 500 companies, including over 300 licenses in her 18-year tenure at Stanford’s OTL with companies, governments and non-profit organizations in the U.S., Europe, Australia, Japan and China.
Ruchika Agrawal, Senior Corporate Counsel, Litigation, Oracle. Ruchika’s litigation experience is complemented by an advanced degree in Computer Science as well as real world programming, non-profit, public policy, and community service work. She works alongside outside counsel as they prepare for and try high-stakes cases. She works with internal clients on resolving different kinds of disputes, involving intellectual property, privacy, security, open source, and contract related issues.
Moderator: Matt Sarboraria, Vice President & Associate General Counsel, Oracle. Matthew leads Oracle’s Patent, Trademark and Copyright group. His team is responsible for developing and implementing strategies and policies for identifying, protecting, and managing the company’s intellectual property. His practice includes patent prosecution and portfolio management, IP licensing, litigation support, M&A support, and copyright, trademark and brand management. He has litigated cases throughout the country involving a wide variety of technologies (database, middleware and application software, semiconductors, computer networking, and telecommunications equipment).
